Limits of Liability – by booking with Jus’ Sail you hereby accept and agree to the following statement:
I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH the activities of sailing and snorkelling, including but not limited to equipment failure, perils of the sea, acts of other participants, and adverse sea and weather conditions, and I HEREBY ASSUME SUCH RISKS. I UNDERSTAND THAT I HAVE DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND THAT OF MY FAMILY INCLUDING ALL CHILDREN AT ALL TIMES AND I AGREE TO DO SO. I also understand that Jus’ Sail accepts no responsibility for any personal effects which I may bring aboard the boat and that I do so at my own risk. Should any loss of personal effects occur for whatever reason I understand that I should seek compensation for that loss from my own travel insurance policy.
I assert that I am physically fit to be a passenger on a sailing yacht, which includes being able to descend steps into the boat to use washroom facilities and a ladder on the side of the boat to enter/exit the water and I will not hold the vessel “Good Expectation” and her crew and/or Jus’ Sail Ltd. its directors or their employees, agents or other associated personnel responsible if I am injured as a result of ANY problems (medical, accidental or otherwise) which occur while chartering the boat or otherwise participating in the trip.
I understand that although Jus’ Sail offers alcoholic beverages throughout its charters that Jus’ Sail does not require me to consume alcohol to participate in the charter. I also acknowledge that it is my responsibility NOT TO BECOME INTOXICATED at any point during the charter, and that Jus’ Sail is not responsible if I become intoxicated. I acknowledge the Captain and crew of the vessel have the right to refuse the serving of any further alcoholic beverages should they deem it a safety risk to my person, that of the other guests, the crew or the vessel to do so. I take full responsibility for any liability associated with my intoxication, during or after the charter. I acknowledge that Jus’ Sail assumes no liability for injuries that may occur to me or others, and no liability for any civil or criminal violation or damages that may be assessed against me as a result of my being intoxicated before, during or after the charter.
I fully understand that the vessel “Good Expectation” has limited medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions.
Jus’ Sail and vessel “Good Expectation”, have made no representations to me, implied or otherwise, that they or their crew can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid, I would like assistance and will not hold Jus’ Sail and vessel “Good Expectation”, their crew or passengers responsible for their actions in attempting the performance of rescue or first aid.
I agree to forever discharge and release Jus’ Sail Ltd. and its directors and vessel “Good Expectation”, its employees and agents and affiliates, from any and all responsibility or liability for any and all injuries or damages. I agree NOT to make a claim against or sue any of the above parties for injuries or damages whether they arise or result from any negligence or other liability. I further specifically agree, on behalf of myself, my heirs and assigns, to indemnify and hold harmless the released parties for any and all causes of action arising as a consequence of any incidents which might occur as a consequence of my participation in any activities with or involving the released parties.
Cancellation Policy
Jus’ Sail require a 50% deposit at the time of booking in order to confirm your charter. As a low volume business with limited spaces it is advisable to book ahead to ensure that you get to sail with us.
We want you to be very comfortable and certain that you do want to sail with us and are here to answer any questions that you may have before you commit to your booking.
Once a booking has been confirmed both parties are committed to undertake it. If Jus’ Sail have to cancel that booking for what ever reason an alternative day will be offered when possible, failing that a refund of the deposit will be given. Jus’ Sail accept no responsibility for cancellations that they may have to impose and no further recourse other than reimbursement of the deposit can be sought.
Should a guest’s circumstances change, that require them to cancel the booking altogether it is advisable to do so as far in advance as possible.
Our cancellation policy is cancellations made 7 days or more before charter date will allow for a full refund of the deposit.
Cancellations made less than 7 days but more than 48hrs will allow for half the deposit to be refunded.
Cancellations less than 48hrs forfeit the deposit.
Cancellations made on the day require payment in full.
In all such situations, guests are advised to seek coverage from their travel insurance to cover their loss.
Cancellation policy due to bad weather
Although St Lucia generally has ideal weather for sailing – warm, sunny and breezy, there are days when the weather is not conducive to a laidback sail.
There is always the chance of showers in the tropics especially on a mountainous island like St Lucia, the occasional shower does not dissuade us and it is very rare that there is too much or too little wind. Cancellations are therefore more likely to be due to extended periods of rain, as Jus’ Sail do not operate their charters on days when heavy and extended rain is likely.
Jus’ Sail will take a view on the weather each day of a charter based upon various weather forecasting resources such as the Martinique rain radar and if heavy and extended rain looks unavoidable then we aim to reschedule the charter for another day. If however, this cannot be done, any deposit paid will be refunded with our apologies.
